Article 1 - Definitions

  1. Environment: the marketplace www.greenbeautyhaven.com.
  2. Platform: the Environment on which products are offered to Users by third parties.
  3. Entrepreneur: Green Beauty Haven who operates the marketplace www.greenbeautyhaven.com.
  4. User: every visitor to the Environment.
  5. Vendor: a third party, being a legal or natural person who offers products to Users via the Platform.
  6. Customer: a User of the Environment who proceeds to purchase a product via the Platform.
  7. Purchase Agreement: the agreement that is concluded between the Vendor and a Customer due to the purchase of a product by the Customer from the Vendor via the Platform.

Article 3 - Applicability

  1. The purchase of products from Vendors via the Platform is subject to the General Terms and Conditions which can be found on the Surroundings of Green Beauty Haven website, www.greenbeautyhaven.com.
  2. By placing an order for a product offered by a Vendor within the Environment, the Customer agrees to these Terms and Conditions. General (purchase) conditions of the Customer are expressly rejected.
  3. Any deviation from these provisions must be made in writing and the remaining provisions will still apply.
  4. These Terms and Conditions are applicable to both consumer and business buyers.
  5. The rights and claims stated in these Conditions also apply to intermediaries and other third parties engaged by the Entrepreneur, including the Vendor(s).
  6. The Entrepreneur reserves the right to modify these Terms and Conditions, with any changes becoming effective upon publication on the website. By placing an order for a Vendor’s product after the amended conditions have been published, the Customer accepts the new Terms and Conditions. It is recommended that Customers review the Terms and Conditions prior to placing an order.

Article 4 - Customer account

  1. In order to use the Platform, the Customer must meet the following requirements: be at least 18 years of age and have a valid email address.
  2. Creating a customer account on the Platform is optional and not necessary to order products. However, the Entrepreneur reserves the right to refuse to process certain orders or impose conditions on them.
  3. The Customer is responsible for the security of their username and password, and the Entrepreneur advises the use of a unique and confidential password. Sharing the account with others is not allowed. Customer is responsible for any use/acting that, with or without Customer’s permission, is used through Customer’s account. Customer is obliged to report all unauthorised use of Customer’s account to Entrepreneur as soon as possible.
  4. The Customer must agree to act in compliance with the Conditions and all applicable laws and regulations. Furthermore, the accuracy of the data in the Customer’s account is the Customer’s responsibility.
  5. Entrepreneur reserves the right to refuse an application for an account or to terminate an existing account after registration, for example if these terms and conditions or other Entrepreneur house rules are violated.
  6. Customer is not permitted to apply for or manage more than one (1) account. The Customer is further not permitted to apply for or manage an account (again) after Entrepreneur has refused a Customer’s application for an account or has cancelled an account after registration.
  7. Entrepreneur reserves the right to change the layout of the Platform (including search options etc.) at any time and at its own discretion without Customer being entitled to compensation or refund of all or part of the price involved in the account and communication; this will therefore never be regarded as a breach of the agreement.

Article 5 - Third party offer

  1. The Customer acknowledges that the purchase agreement is between them and the Vendor (a third party who offers products for sale through the Environment) and that the Entrepreneur is not a party to this agreement, nor does it become one. Disputes arising from such an agreement should be resolved by the parties themselves. Entrepreneur plays no role in this.
  2. If the Customer has any questions or complaints about a product purchased from a Vendor, they may contact the vendor directly or contact the Entrepreneur.
  3. The Customer also acknowledges that the Entrepreneur is not responsible for any defects or issues with the purchased product, and is not liable in any way.

Article 6 - Order and delivery

  1. Through the ordering process, a Customer can purchase a product offered by a Vendor on our platform.
  2. Typically, the Vendor provides a packing slip with the delivered product, but if not, the Customer can contact our customer service (info@greenbeautyhaven.com) to request it.

Article 7 - Reimbursement and payment

  1. The Customer is responsible for paying the purchase price of the product bought from the Vendor through the Platform and cannot fulfill their payment obligation by directly paying the Vendor. Payment must be made to the Entrepreneur.
  2. The Vendor has granted the Entrepreneur exclusive collection rights in their name that arise from the purchase agreement between the Customer and the Vendor.
  3. Entrepreneur will handle any claims against the Customer in accordance with their standard collection policy.
  4. Without explicit and written consent from Entrepreneur, the parties are not permitted to apply set-off and/or suspension and/or deduction in respect of its payment obligations.
  5. All payments through the Platform are made through the payment option Stripe. Stripe’s general terms and conditions therefore apply to payment transactions. The Customer declares to have received and agreed to Stripe’s terms and conditions.

Article 8 - Procedures applicable to each purchase made from Vendor(s)

  1. For every purchase made by a Customer from a Vendor through the platform, the Customer is responsible for, if applicable, reviewing and agreeing to the general terms and conditions of sale provided by the relevant Vendor. If applicable, these terms and conditions are available on the Vendor’s page on the platform and will govern the processing of the customer’s order.
  2. If the Customer wishes to return an order within the time frame specified in the Vendor’s terms and conditions (in accordance with the “right of withdrawal”), they may do so and receive a refund subject to the provisions outlined in the terms and conditions. During the 14-day return period, the Customer must handle the product and packaging with care and only use the product to the extent necessary to assess whether they wish to keep it.
  3. When returning a product, the Customer must adhere, if applicable, to the Vendor’s return policy, which can be found on the Vendor’s page on the platform. The Customer should make every effort to return the item to the vendor within 24 hours of reporting the return shipment.
  4. Once the Vendor receives the returned product in good condition, the platform will refund the purchase amount to the Customer. If the vendor accepts responsibility for the return shipping costs, this will be stated on their page on the platform. If a vendor does not accept an order within two working days, the platform will inform the Customer within eight working days and return any payment already received.

Article 9 - Handling and processing of information and data

  1. The Customer is responsible for monitoring their email to promptly receive any information sent by the entrepreneur. The entrepreneur is not responsible for any delays or errors in the transmission of information, regardless of its source or intended recipient.
  2. Furthermore, the Customer acknowledges and consents to the disclosure of their name and address details to the Vendor to facilitate the purchase agreement/order, or with the Customer’s explicit consent. The Vendor is only permitted to use the Customer’s data for the purpose of processing and executing the purchase agreement/order, or with the Customer’s explicit consent.
  3. The Customer is solely responsible for checking the information provided by the Vendors.
  4. All information provided through the Platform is for indicative purposes only and therefore no rights can be derived from it.

Article 10 – Liability

  1. Entrepreneur is not responsible for the quality and quantity of display of any account or communication on the website or otherwise.
  2. Customer is himself responsible for the content of the account or communication and indemnifies Entrepreneur – in and out of court – against any claims by third parties in this respect against him.
  3. Entrepreneur is in no way liable for any damage resulting from the (temporary) unavailability of the account or communication.
  4. In the event of any shortcomings in the fulfilment of the agreement on its side, Entrepreneur will only be obliged to adjust the account or communication, extend the publication or credit the costs, without Customer being able to assert any right to any compensation or damages whatsoever.
  5. Should Entrepreneur be liable towards Customer without delay, then this liability will at all times be limited to the amount to which the professional or business liability insurance taken out by Entrepreneur gives entitlement, or otherwise to the amount of any fee for the event causing the damage, to be increased by 15%.
  6. Entrepreneur’s liability at all times does not extend to consequential loss or damage and, barring intent or gross negligence, also not to property damage, immaterial damage or loss of profit.

Article 11 - Miscellaneous

  1. The Entrepreneur reserves the right to limit, deny, or revoke certain privileges, block account usage or order placement, or restrict access to certain products from Vendors through the Entrepreneur’s platform, at their sole discretion, based on the trading history of a Customer.
  2. In the event that the Entrepreneur allows deviations from the terms and conditions, either implicitly or explicitly, for a short or extended period, this does not waive their right to demand immediate and strict compliance with the terms and conditions. The Customer cannot claim any rights based on the Entrepreneur’s smooth application of the terms and conditions.
  3. If any provision of the Entrepreneur’s conditions or procedural rules conflicts with applicable legal provisions, the relevant provision will be replaced by a new legally permissible provision determined by the Entrepreneur, to the extent possible considering the scope of the relevant provision.
  4. Finally, the Entrepreneur retains the right to discontinue the availability of Vendor functionalities on the Entrepreneur’s website at any time.

Article 12 - Applicable law

  1. The Terms and Conditions, the purchase / sale of items by Vendor via the Entrepreneur website and the Purchase Agreement between the Customer and the Vendor are exclusively governed by Dutch law, with the express exception of the Vienna Sales Convention. All disputes between parties will be submitted to the competent court in which Entrepreneur’s headquarters is located.
